Why Don't The Properties Listed In The RDTS Go To Constable Sale Auctions?
Typically, very few do. Those that DO go to Foreclosure are handled by the Constable Sales held the first Tuesday of the month at The Family Law Center, 1115 Congress Houston, Texas 77002 The RDI Foreclosure Report identifies the Delinquent Taxing Authority that moved the property forward to a Constable sale.
The Reason Why So Few Properties Are Moved To A Constable Foreclosure Auction Is Simple. The Taxes Owed Approach Or Exceed The Value Of The Property And The Chance Of Obtaining A Buyer At A Constable Sale Is Slim And Not Worth The Expense And Effort To Move These Properties Forward.
Can Investors Purchase These Delinquent Properties Directly From The Requisite Taxing Authority
Without A Constable Auction?
In Theory, And According To The Law, Yes. However, Most Harris County Taxing Authorities Will Not Permit This Perfectly Legal Transaction. The Reasons Are Many, Including The Possibility That The Tax Agencies May Be Able To Acquire These Properties For Their Own Inventory.
Currently, Investors Can Pay A $50.00 Fee To The Applicable Tax Authority, And Move The Property To A Constable Sale. The Investor Is Not Given Any Preferential Status, Although The Taxing Authority Will Take Their Money And 'Note Their Interest'.
It is Far Better For An Investor To Approach The Property Owner, Obtain The Appropriate Option To Purchase, Remit The Delinquent Taxes And Subsequently Own The Property. Obviously, Due Diligence And A Title Search To Uncover Any Other Liens Or Encumbrances Is A Necessity.
What Are The Possible Causes Of Property Tax Delinquency?
The Obvious Reason For A One Or Two Year Tax Delinquency Is Simply That The Taxes Have Not Been Paid. This Does Not Mean There Is No Mortgage Or Home Equity Loan Or Other Liens Against The Property That May Affect The Overall Desirability From An Investors Viewpoint.
Where A Mortgage Or Home Equity Loan IS Involved, The Reasons For Tax Delinquency Can Be:
1. The Homeowner's Down Payment Did Not Require PMI (Private Mortgage Insurance) By The Lender To Secure The Property Against Tax Default By The Homeowner. With No Escrow Account Kept By The Lender Wherein Taxes Are Paid Annually Through A Third Party Fiduciary (Such As First American Real Estate Tax Services), the Homeowner Was Responsible For the Tax Themselves and Simply Did Not Pay..
2. The Lender's Fiduciary Paid Taxes On The Incorrect Property-This Happens Approximately 2% Of The Time.
In These Cases, The Homeowner Would Be Unaware That Their Taxes Had become Delinquent Since The Lender Would Have Escrowed The Taxes From The Homeowner's Monthly Payment For Up To One Year (Depending Upon The Taxing Authorities Involved.)
Where A Mortgage Or Home Equity Loan IS NOT Involved, The Reasons For Tax Delinquency Can Be:
1. The Mortgage Has Been Paid In full-The Homeowner Is Directly Responsible For Paying The Taxes and Has Failed To Do So.
2. A Death Of The Homeowner With No Clear Responsible Heir To Pay The Taxes Or The Property Is In Probate And There Are No Funds To Pay The Taxes.
Clearly, It Is Very Important To Determine The Cause Of The Tax Delinquency Before Investing Time and Effort In The Property. ALWAYS DO A TITLE SEARCH AND DUE DILLIGENCE
